These Terms of Service ("Terms") constitute a legally binding agreement between Akureka Solutions Sdn Bhd ("Company", "we", "us", or "our") and the individual or business entity ("Merchant", "User", or "you") subscribing to or accessing the PollPrice platform available at https://pollprice.com (the "Service").

By creating an account, launching the radar dashboard, or accessing the PollPrice API, you agree to be bound by these Terms.

PollPrice is a multi-tenant B2B competitor price intelligence platform providing automated polling, variant extraction, multi-currency normalization, and outbound price change alert notifications.

1. Account Security: You are responsible for safeguarding your login credentials and API tokens. You must immediately notify Akureka Solutions Sdn Bhd at [email protected] of any unauthorized account activity.
2. Entitlements & Quotas: Each subscription tier (Free, Pro, Ultra) enforces database-driven limits on tracked URLs, polling frequency (e.g. 24h, 4h, 30m), historical retention, and alert channels. Attempting to circumvent these limits is a material breach of these Terms.
3. Master SKU Free Benchmark Slots: Master SKU slots permit Pro and Ultra merchants to benchmark internal catalog items at zero quota cost. You represent and warrant that you own or are authorized to track the storefront URLs registered as your Master SKUs.

You agree to use PollPrice exclusively in compliance with all applicable local, national, and international laws. Specifically, you agree NOT to:

1. Use the Service to launch Denial of Service (DoS) attacks or intentionally flood third-party e-commerce servers.
2. Circumvent, disable, or tamper with our poller's built-in 2-to-5 second crawl delay or HTTP 429 circuit breaker rate limits.
3. Attempt to reverse engineer, decompile, or extract the source code of the PollPrice scraper engine or proprietary queue scheduler.
4. Resell, white-label, or sublicense access to PollPrice without prior written authorization from Akureka Solutions Sdn Bhd.

1. "As-Is" Data Provision: Price data, availability indicators, and FX currency calculations provided by PollPrice are compiled from automated scans of publicly available web pages. While we employ multi-layered parsing heuristics (JSON-LD, microdata, and headless DOM inspection), we do not warrant that scraped data will be 100% error-free, complete, or uninterrupted.
2. Independent Commercial Discretion: You retain sole responsibility for your retail pricing, promotional campaigns, inventory management, and margin decisions. Akureka Solutions Sdn Bhd shall not be liable for any lost profits, revenue discrepancies, or commercial damages resulting from automated price alerts or poller latency.

1. Subscription Fees: Paid tiers (Pro, Ultra) are billed in advance on a recurring monthly basis. All charges are non-refundable except where required by law.
2. Upgrades & Downgrades: Tier changes take effect immediately. Upgrades are charged on a pro-rata basis for the remainder of the billing cycle.
3. Cancellation: You may cancel your subscription at any time via your workspace billing portal. Upon cancellation, your workspace retains active tier entitlements through the end of the current paid billing cycle, after which it reverts to the Free tier.

PollPrice, its software architecture, visual interface, logos, documentation, and database schemas are the exclusive intellectual property of Akureka Solutions Sdn Bhd and are protected under international copyright, trademark, and trade secret laws.

To the maximum extent permitted by applicable law, in no event shall Akureka Solutions Sdn Bhd, its directors, employees, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of PollPrice.

Our aggregate liability for all claims arising under these Terms shall not exceed the total amount paid by you to Akureka Solutions Sdn Bhd during the twelve (12) months immediately preceding the event giving rise to liability.

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to conflict of law principles. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Kuala Lumpur, Malaysia.

Akureka Solutions Sdn Bhd reserves the right to modify these Terms at any time. If revisions are material, we will provide at least 14 days' notice prior to the new terms taking effect. Continued use of PollPrice following notification constitutes acceptance of the revised Terms.
